For 30 years, the law firm of Shor & Levin has specialized in workers’ compensation cases. Through the years, the firm developed first-hand knowledge of changes in workers’ compensation law; rules that affect Social Security Disability and Medicare; and numerous complex litigation issues.

In 1996 managing partner Jay Shor met with a group of Pennsylvania legislators to discuss workers’ compensation. He told the legislators that there were two types of cases that can’t be settled: A custody case where both parties agree on some schedule and workers’ compensation cases because back then lawyers need to develop a hypothetical earning capacity and a complicated formula to settle the case. The medical portion of the case remained open so the adjustors and insurance company had to continue to pay so there was no way to end the case.

This conversation led the legislators to develop the basis for the Compromise and Release Settlement which allows an injured person to get value for their case in the form of future benefits indemnity and for future medical benefits all in one lump sum so they can get on with their life and be productive again.
